Lender Disputes
At Mazzarella Law APC, we and our predecessor firms have represented both borrowers and lenders in a wide variety of lender disputes cases, including contract disputes and foreclosures. The following are a few representative matters:
- We obtained a $27 million judgment in favor of a large national bank in a suit on a real estate developer’s personal guarantee.
- We substituted in as counsel just days before trial to represent a real estate developer who was sued on his personal guarantee for over $2.7 million and who had filed a cross-complaint for bad faith against the lender. We obtained a defense verdict on the lender’s complaint and a verdict in excess of $3 million on the borrower’s cross-complaint.
- We successfully resolved, either by negotiated settlements or in court proceedings, a half dozen suits by lenders who sought in excess of $40 million from a real estate developer in the wake of the 2007-2008 real estate collapse — for less than 1 percent of the amount sought.
- We obtained defense verdicts in a case in which we substituted in as attorneys for a local bank, its general counsel and the head of its trust department the afternoon of the first day of trial after the court ruled against our clients on a number of key pretrial motions.
